Terms of Service

These Terms of Service (“Agreement”) are entered into by the Good Mood Co UG (hereinafter “The Good Mood Co”, “we”, “us”, “our”) and the users agreeing to these terms (“users”, “you”, “your”) and govern your access to and use of our services, including the use of our preventative health platform, TGMC Platform (as defined below), and our website, email, notifications, applications, and other covered services including conduct of health checks,the blood draw process, home test packages, wellness coaching, and creation of personalised health plans. This Agreement shall be effective when you click to accept it (the "Effective Date"). If you are accepting on behalf of a user, you represent and warrant that (i) you have full legal authority to bind the user to this Agreement; (ii) you have read and understand this Agreement; and (iii) you agree, on behalf of the user, to this Agreement.

This Agreement is governed by and construed in accordance with all applicable European, German, and UK laws and regulations on healthcare and digital health applications and telemedicine services, consumer protection, electronic commerce, and electronic transactions, anti-corruption, data protection, unfair competition and health insurance coverage  including, without limitation, the German Telemedia Act (Telemediengesetz - TMG), the Act Against Unfair Competition (Gesetz gegen den unlauteren Wettbewerb, UWG), the Medicinal Products Act (Arzneimittelgesetz, AMG), the German Naturopathic Practitioners Act as amended and in force, the German Civil Code (Bürgerliches Gesetzbuch - BGB), E-Commerce Directive (Directive 2000/31/EC), Directive 2011/83/EU on consumer rights, Directive 2013/11/EU on alternative dispute resolution for consumer disputes, Regulation 524/2013 on online dispute resolution for consumer disputes, the EU General Data Protection Regulation 2016/679, the UK Data Protection Act 2018, the Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), and any other applicable laws, regulations, rules, guidelines, and industry standards ("Applicable Laws").

By accessing and using TGMC Platform, you acknowledge that your interactions with us, including the purchase of any Services, constitute electronic transactions governed by Applicable Laws.

1. Definitions

“Documentation” means the online information, product descriptions, manuals, and materials relating to the use of the TGMC Platform made available to the user in connection with the use of the TGMC Platform.

“Initial Term” has the meaning set forth in Section 16.

“Order” means an order placed by a user through the TGMC Platform for the purchase by user of remote access to and use of a Service issued from time to time pursuant to and subject to this Agreement.

“Renewal Term” has the meaning set forth in Section 16.

“Services” means all the paid offerings provided by The Good Mood Co which include the use of the TGMC Platform, the Membership Services (as defined below) and Additional Purchases (as defined below) any membership package or additional services available for Order through the TGMC Platform as well as any products ordered as part of or resulting from such services.

“Membership Services” means any suite of Sservices provided by the TGMC Platform to users who have registered for and maintain an active membership with the TGMC Platform.

“Additional Purchases” refers to any supplementary Sservices acquired by a subscribed member of TGMC Platform beyond the scope of the standard Membership Services.

“Subscription Fees” means the annual fee paid by user for the right to access and use the Services and receive standard support. The Subscription Fees for Services for the Initial Term are displayed on the TGMC Platform, in the relevant sections where comprehensive details of the Membership Services are provided . Unless otherwise set forth in the applicable Order or agreed to by the parties, the Subscription Fees for any Renewal Term shall be The Good Mood Co’s then-current product list price.

Add-On Fees: refer to additional charges incurred for ordering Additional Purchases. The Add-On Fees are determined based on the current price set by the TGMC Platform for the respective service at the time of purchase.

“Term” means the Initial Term and any Renewal Term applicable to each Order.

“Third-Party Provider” means independent entities, such as Designated Laboratories (as defined below) and infrastructure service providers, who are not employees or agents of The Good Mood Co but who provide various services or products in connection with TGMC Platform's health and wellness offerings.

“Designated Laboratory” refers to the certified and authorized laboratory selected by The Good Mood Co for the analysis of any samples collected in the course of Membership Services.

“TGMC Platform” has the meaning set forth in Section 2.

“Healthcare Professional” (HCP) means members of the medical, dental, pharmaceutical, or nursing professions., as well as any other person authorised to prescribe, supply, or administer medicinal products in the course of their professional activities.

“Non-Medical Practitioner” (Heilpraktiker) means any healthcare provider, other than Healthcare Professional, who practices medicine professionally focusing on holistic, naturopathic, or alternative treatments.

2. Provision of the Services

Scope of Services. The Good Mood Co provides a preventive health platform in the field of functional medicine (the “TGMC Platform”) dedicated to promoting health and wellness through holistic naturopathic and healing services, as well as  a variety of supportive services such as wellness and coaching options. 

Membership Services

By placing an Order through the TGMC Platform for a membership package, you gain access to the following suite of Services:

Annual Health Check

Blood Test: One venous blood test per year conducted by licensed and qualified Third-Party Providers. The procedure will be carried out by a Third-Party Provider, and you agree to comply with their terms and conditions. The Good Mood Co is not responsible for any acts or omissions of the Third-Party Provider. Any concerns should be directed to the Third-Party Provider. The appointment can be scheduled online through the TGMC Platform; however, the actual appointment and service delivery are managed by the Third-Party Provider. The blood sample will be sent to our Designated Laboratory which will conduct the analysis and upload the results to your secure account on the TGMC Platform.

Gut Microbiome and Saliva Cortisol Tests: An at-home test package for stool and saliva sample collection will be shipped to you. You are responsible for ensuring the provided address is accurate and for following the instructions included in the package. You shall use the provided pre-paid return shipping label to send your samples back to our Designated Laboratory. The Designated Laboratory will conduct the analysis and upload the results to your secure account on the TGMC Platform.

Our Non-Medical Practitioners and other alternative practitioners will analyze these results with the support of advanced AI technology to provide you with personalized naturopathic and healing solutions. 

While the TGMC Platform ensures that only pseudonymised data is shared with Designated Laboratories for the purpose of sample analysis, users acknowledge that in the event of an incidental adverse finding in the laboratory results, the TGMC Platform may disclose full personal data to the Designated Laboratories as required by their internal health and safety policy for proper follow-up and care. The Good Mood Co undertakes that such disclosure is in accordance with all Data Protection Laws and is solely intended to address any critical health issues identified during the analysis. In case of such incidental findings, you will be informed immediately either by the laboratory doctor or by The Good Mood Co. Healthspan Coaching

You will have access to one annual personalised healthspan coaching session with a certified health coach.

Additional Purchases

Additional Purchases are offered through the TGMC Platform to enhance your preventive health and wellness experience and may incur separate charges. Additional services and products are intended for the exclusive use of the user and are subject to the same terms of use and privacy policies as the standard Membership Services. 

Services Use

During the term of the Agreement, The Good Mood Co will provide the Services in accordance with this Agreement, and the user may use the Services in accordance with the Agreement. The user agrees not to access or use the Services outside the scope of the rights that are expressly granted by The Good Mood Co in this Agreement and the Documentation.

3. Accounts

You Setting up your account and gaining access to the TGMC Platform is completely free of charge. You must have an account to use the Services and are responsible for the information you provide to create the account, the security of your passwords for the account, and for any use of your account. The Good Mood Co has no obligation to provide multiple accounts to a user.

To sign up and create an account, you will be asked to provide your name and email and complete a short questionnaire about your health, lifestyle, and preferences. The codes that are used to identify you are: the login code (e-mail or username) and the personal security code (password), which allow you to safely log into your personal account as a registered user.

For security reasons, we recommend that you change your password at regular intervals and avoid using easily detectable passwords (e.g., date of birth). You are responsible for maintaining the confidentiality of your credentials and for limiting access to your computer. You must notify us immediately if you believe your password has been disclosed or is being used in an unauthorised manner.

Once you've completed the account setup process, you can explore and choose from our Membership Services or Additional Purchases that best suit your needs.

You accept and commit to not use the TGMC Platform to send, transmit, publish, or in any other way distribute illegal, damaging, threatening, racist, insulting, annoying, libellous, slandering, vulgar, immodest, or harmful content.

Deletion of Your Account

You may permanently delete your account by visiting the “Delete Account” section in the app settings. In this case, the deletion of your account is immediate, final and irreversible.

4. Access and Use of Services

4.1 Service Eligibility

The services offered by The Good Mood Co are designed to provide preventive health and wellness support to eligible individuals. By accessing and using our Services, you agree to the following requirements:

Age Requirement:

Minimum Age: You must be at least 18 years old to register for and use the services provided through the TGMC Platform. By creating an account and using our Services, you represent and warrant that you meet this age requirement.

Geographic Restrictions:

Location: Our Services are currently available to individuals residing in Germany. By using our Services, you represent and warrant that you are located in this region. We reserve the right to restrict access to our Sservices in certain geographic areas at our discretion.

Health Status:

Health Conditions: The Sservices provided through the TGMC Platform are intended for individuals seeking preventive health measures and general wellness support. They are not suitable to treat medical conditions  for individuals with certain pre-existing medical conditions that may require specialised medical care. You agree to disclose any significant health conditions during the registration process or when using our Services. The TGMC Platform also does not issue any certificates or formal documentation related to medical or health conditions. As Non-Medical Practitioners are not authorized to provide official medical certificates, users should not expect to receive such documentation through our Services. For any certification needs, including medical certificates or other official documentation, users are advised to consult with HCPs who are authorized to provide such certificates.

5. Ownership and Use of Customer Data

5.1 Customer Data

The Good Mood Co does not own any data entered or uploaded to the TGMC Platform by or on behalf of user or other material that user submits to the TGMC Platform in the course of using the Services (“Customer Data”). User has sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right of use of all Customer Data. The Good Mood Co may use Customer Data solely for purposes of providing the Services, providing support and confirming user’s compliance with the terms of this Agreement.

5.2 Usage Data

The Good Mood Co may record anonymised information and data about how user uses the Services such as the number of views per page, session length, task completion, number of log-ins, and other statistical and performance information related to the provision and operation of the Services (“Usage Data”). Usage Data does not contain any Customer Data, Customer Confidential Information, or data that personally identifies an individual or that is business specific.

6. Proprietary Rights

6.1 Ownership

As between the parties, The Good Mood Co retains all title, intellectual property, and other ownership rights in the Services including the TGMC Platform, the Documentation, and Usage Data. User retains all title, intellectual property, and other ownership rights in all Customer Data.

6.2 No Implied Rights

There are no implied rights and all other rights not expressly granted herein are reserved. No license, right, or interest in TGMC Platform or any Good Mood Co software, trademark, copyright, trade name, or service mark is granted hereunder. User is not acquiring any right or interest in the Services or the Documentation except the right to access and use the Services and the related Documentation.

7. Confidentiality

Each party agrees: (i) that it will use (and will ensure that its employees, affiliates, agents, contractors, and other allowed third parties use) reasonable efforts to prevent the disclosure of the other party’s Confidential Information to any person or entity, unless authorised by the other party; and (ii) that it will not use Confidential Information of the other party for any purpose other than as authorised by this Agreement or by the other party. As to Good Mood Co, the term “Confidential Information” includes information specifically designated as confidential or that would be understood to be confidential or proprietary by a reasonable person, the features and functions of the TGMC Platform that are not available to the general public via the public internet (including screenshots of the same), future product plans, any Documentation or specifications provided to user, the commercial terms (including pricing) of this Agreement and any Orders, audit, performance, and security test results (whether conducted by Good Mood Co or user), and any other proprietary, financial, or business information supplied to user by Good Mood Co. As to user, the term “Confidential Information” includes information specifically designated as confidential or that would be understood to be confidential or proprietary by a reasonable person, login credentials for accessing the TGMC Platform, and Customer Data (including personal data and sensitive data). Notwithstanding the foregoing, “Confidential Information” shall not include (i) information which is or becomes publicly known through no act or omission of the receiving party, or (ii) information gained by the receiving party independent of the disclosing party that is not under an obligation of confidence to the disclosing party. Notwithstanding the foregoing, it shall not be a breach of this Agreement to disclose Confidential Information to the extent such information is required to be disclosed pursuant to administrative or court order, government or regulatory investigation or requirement, or arbitration or litigation arising out of this Agreement; provided, however, that to the extent permissible, each party shall, in advance of any such disclosure promptly notify the other party in order to enable the other party to seek a protective order with respect to the requested information or otherwise challenge or oppose the disclosure requirement.

8. Compliance With Applicable Laws and Disclaimers

8.1

The parties represent and warrant that the transmission of any medical information to Healthcare Professionals through the TGMC Platform shall not constitute an inducement to recommend, prescribe, purchase, supply, sell, or administer a particular prescription-only medicinal product as defined in the Applicable Laws. Also, the user undertakes that any medical or health information transmitted through the TGMC Platform shall be balanced and accurate, fair, objective, and sufficiently complete as required by the Applicable Laws. Finally, in no case shall any medical or health communication transmitted through the TGMC Platform substitute the practice of medicine based on the direct doctor-patient relationship and the individualised diagnosis and treatment of diseases by specialists.

8.2

The services provided by TGMC Platform are intended solely for informational purposes and do not constitute a referral, endorsement, or recommendation to any Healthcare Professional or Non-Medical Practitioner , including but not limited to physicians, specialists, laboratory doctors and alternative practitioners. Good Mood Co does not engage in practices that encourage undue preference to specific Healthcare Professionals or Non-Medical Practitioners.

8.3

The TGMC Platform is intended solely as a supportive tool to assist users in their health and wellness goals. The information and Services provided by TGMC Platform are not a substitute for professional medical advice, diagnosis, or treatment. Also, Tthe Services provided on TGMC Platform are intended solely for informational and general wellness purposes. The TGMC Platform focuses on holistic, naturopathic, healing or alternative treatments which are not a substitute for conventional medical care but may complement traditional healthcare practices. All Non-Medical Practitioners associated with the TGMC Platform adhere to the highest standards of business and ethical conduct. These practitioners are licensed under the Heilpraktikergesetz (HeilPrakG) and comply with the Professional Code for Alternative Practitioners. This ensures that their practices meet stringent regulatory and ethical requirements, maintaining the integrity and quality of Services provided through the TGMC Platform.

The TGMC Platform does not constitute a medical device as defined under the European Union Medical Device Regulation (EU MDR) (Regulation (EU) 2017/745) and should not be used as such. You should consult with a qualified healthcare provider for any medical concerns or conditions.

8.4

The AI tools provided by TGMC Platform are designed to supplement and support the medical advice of our dedicated healthcare team. These tools are intended for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. To the extent that any personalised health recommendations are generated through our AI tools, you acknowledge that the AI-generated recommendations are supplementary and should not be considered as a standalone solution. The AI tools employed by TGMC Platform do not establish a doctor-patient relationship and should not be relied upon as the sole source of medical advice. By gaining access to any personalised AI-generated health recommendation through TGMC Platform, you agree that you will not disregard professional medical advice or delay seeking medical treatment for a health condition based on such recommendations. While TGMC Platform strives to ensure the accuracy and reliability of the AI-generated recommendations, we do not guarantee their correctness, completeness, or applicability to your specific health condition. The AI tools are continually evolving, and the recommendations may not reflect the most current medical research or practices.

9. Limited Warranty

The Good Mood Co represents and warrants as follows: (i) Services shall be provided in a professional manner consistent with industry standards; (ii) Good Mood Co possesses all rights necessary to grant to user the rights set forth in this Agreement; (iii) the TGMC Platform will perform substantially in accordance with the service description and the Documentation. User must notify The Good Mood Co in writing of any claim that the TGMC Platform does not perform substantially in accordance with the Documentation no later than thirty (30) days after the last day of the month in which the asserted non-performance occurred.

10. Disclaimer of Warranties

Disclaimer. User assumes sole responsibility and liability for results obtained from the use of the Services and for conclusions drawn from such use. The Good Mood Co shall have no liability for any claims, losses, or damage caused by errors or omissions in any information provided to Good Mood Co by user in connection with the Services or any actions taken by Good Mood Co at user's direction. The Good Mood Co shall have no liability for any claims, losses, or damages arising out of or in connection with user’s use of any third-party products, services, software, or websites that are accessed via links from within the Services. For any breach of warranty claim relating to Services, user's exclusive remedy and Good Mood Co’s entire liability shall be for Good Mood Co to re-perform the deficient Services.

EXCEPT AS EXPLICITLY SET FORTH IN SECTION 9 OR TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS-IS” AND “AS-AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. GOOD MOOD CO DISCLAIMS AND EXCLUDES ALL WARRANTIES, CONDITIONS AND OTHER TERMS IMPLIED BY STATUTE, COLLATERALLY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND QUALITY OF INFORMATION. GOOD MOOD CO DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, MEET USER’S SPECIFIC NEEDS, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED. USER EXPRESSLY AGREES AND ACKNOWLEDGES THAT THE USE OF SERVICES IS AT USER’S SOLE RISK. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY GOOD MOOD CO OR AUTHORISED REPRESENTATIVES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF GOOD MOOD CO OBLIGATIONS HEREUNDER.

11. Limitation of Liability

Each party's total aggregate liability for damages arising out of or relating to the Agreement is limited to the fees user paid during the 12-month period before the event giving rise to liability.

IN NO EVENT WILL EITHER PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR ANY LOSS OF REVENUE, PROFITS, DATA OR DATA USE ARISING OUT OF THIS AGREEMENT. GOOD MOOD CO’S MAXIMUM LIABILITY IN CONNECTION WITH THIS AGREEMENT, ON THE BASIS OF ANY THEORY OF LIABILITY OR CAUSE OF ACTION, SHALL BE LIMITED TO THE FEES COLLECTED BY GOOD MOOD CO FROM USER PURSUANT TO THIS AGREEMENT IN THE TWELVE MONTHS PRECEDING THE IMPOSITION OF LIABILITY (OR, IF LIABILITY ARISES IN THE FIRST TWELVE MONTHS OF THE TERM, THE FEES PAYABLE TO GOOD MOOD CO BY USER PURSUANT TO THE ORDER DURING THE FIRST TWELVE MONTHS OF THE INITIAL TERM). THE EXCLUSIONS AND LIMITATIONS OF THIS SECTION DO NOT APPLY (A) TO THE EXTENT PROHIBITED BY APPLICABLE LAW, (B) TO USER’S CONTRACTUAL PAYMENT OBLIGATIONS, (C) TO THE OBLIGATIONS SET FORTH IN SECTIONS 5, 6, 7, 13.

12. Fees and Payment Methods

12.1 Fees

User agrees to pay to The Good Mood Co the Subscription Fees and any other Add On Fees for the Services as expressly detailed within the respective product descriptions. The Good Mood Co provides the Services both on a subscription basis and as standalone purchases and as such, except as otherwise set forth in this Agreement or in the Cancellation and Refund Policy, all Subscription Fees and other Add On Fees paid or owed pursuant to an Order placed through the TGMC Platform are non-cancellable and non-refundable for the applicable term.

12.2 Taxes

All Subscription Fees, Add-On Fees and other charges payable by user to The Good Mood Co, under this Agreement are stated exclusive of all local and foreign taxes, levies, and assessments of any nature (including value-added, use, or withholding taxes).

12.3 Payment Methods

The Good Mood Co offers various payment methods for the convenience of users to Our Services on the TGMC platform. Users may choose from the following payment options:

  • Credit/Debit Card: We accept major credit and debit cards, including Visa, MasterCard, and others.
  • PayPal: PayPal is a secure payment gateway that allows users to complete their payment without disclosing any bank/card information to The Good Mood Co.
  • Other Methods: Additional payment methods may be available as indicated on the Platform at the time of purchase.

The Good Mood Co places great importance on the security of your electronic transactions and takes all necessary measures, with the most advanced and modern systems, to strengthen online security. All information about your transactions and your Personal Data is kept secure and confidential. For more details, please visit our Privacy Policy.

12.4 Coverage of Laboratory and other Third-Party Provider Costs

The Good Mood Co assumes full responsibility for covering all costs and expenses associated with Designated Laboratories and other Third Party Providers, ensuring that the user incurs no additional charges other than the Subscription Fees and any other Add-On Fees. Specifically for the Designated Laboratories issuing test results as part of the Membership Services, the Good Mood Co assumes the user's debt in accordance with Applicable Laws, and pays any Designated Laboratory for such health tests. This arrangement relieves users from any obligation to make direct payments to Designated Laboratories. The Good Mood Co warrants that it has entered into a separate agreement with each of the Designated Laboratories governing all the specific terms of such arrangement and undertakes that it will assume and fulfill all payment obligations to the Designated Laboratories. By subscribing to Membership Services, you agree to this payment structure. Any issues regarding payments should be directed to TGMC’s customer support.

12.5 Insurance Coverage

Users are required to pay all Subscription Fees and Add-On Fees out of pocket. The Services are not covered by statutory health insurance or private health insurance under Applicable Laws. By agreeing to this Agreement, you acknowledge and accept full responsibility for all costs and fees associated with the Services provided through the TGMC Platform.

13. Indemnification

13.1 Good Mood Co Indemnification Obligations

The Good Mood Co shall defend, indemnify, and hold harmless user from and against all losses arising out of or resulting from any third-party claim, suit, action, or proceeding arising out of or resulting from an allegation that any Services or the TGMC Platform infringes the third party's intellectual property rights. Losses shall mean all reasonable attorney’s fees, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, costs, or expenses.

13.2 User Indemnification Obligations

User agrees to defend, indemnify, and hold harmless The Good Mood Co from and against all losses (as defined in Section 13.1) arising out of or resulting from any third-party claim, suit, action, or proceeding arising out of or resulting from (i) user’s or an authorised user’s use of the Services other than in accordance with this Agreement and the relevant Documentation; and (ii) any use of the Services, including the TGMC Platform, in combination with third-party products including hardware and software which may cause infringement of third party’s intellectual property rights.

14. Data Protection

The user and The Good Mood Co shall comply with all applicable data protection and privacy laws and regulations in the performance of their obligations set out under this Agreement, including the EU General Data Protection Regulation 2016/679 (“GDPR”), the UK Data Protection Act 2018, the Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), and all other successor legislation and regulations thereto (“Data Protection Laws”).

The Good Mood Co processes Personal Data (as such terms are defined in the Data Protection Laws) which it collects as a Data Controller or Data Processor (as the terms are defined in the Data Protection Laws) in the course of providing the Services. Where Personal Data is processed by The Good Mood Co as a Data Controller, such processing is carried out in accordance with The Good Mood Co’s Privacy and Cookies Policy.

15. Applicable Law

This Agreement shall be interpreted and construed in accordance with the laws of England and Wales, without regard to its conflict of laws provisions.

16. Term & Termination

16.1 Term of Agreement and Renewal

Your membership with TGMC Platform begins on the date of your successful registration and payment of the membership fee and will continue for the initial annual period selected during your registration (“Initial Term”). Your membership will automatically renew for successive periods equal to the Initial Term (“Renewal Term”) unless you cancel your membership prior to the renewal date. Renewal charges will be billed to the payment method on file unless updated.

16.2 Right to Withdraw and Terminate

Right of Withdrawal: If you are a consumer residing in the European Union, you have the right to withdraw from any Services within 14 days without giving any reason. For more details, please visit our Cancellation and Refund Policy.

Termination by User: You may cancel Services at any time by logging into your account and following the cancellation instructions. Cancellation will take effect at the end of your current billing cycle, and you will retain access to membership services until then. Refunds for canceled memberships are subject to our Cancellation and Refund Policy, which can be reviewed on our website.

Termination by The Good Mood Co:

  • For Cause: The Good Mood Co reserves the right to terminate Services immediately and without notice if you violate this Agreement, engage in conduct that we determine to be harmful or inappropriate, or fail to comply with Applicable Laws.
  • Without Cause: The Good Mood Co may also terminate Services for any reason by providing you with 30 days' notice via email or other written communication. In such cases, you will receive a prorated refund of any prepaid membership fees.

16.3 Effect of Termination

Upon the termination or expiration of this Agreement in accordance with the terms of this Agreement, the following terms shall apply: (a) Your access to The Good Mood Co’s Services will be immediately revoked, (b) You will no longer have access to any premium features, personalised health plans, or other membership benefits. The TGMC Platform will retain your personal data in accordance with our Privacy Policy.

17. Amendment to This Agreement

The Good Mood Co reserves the right to amend this Agreement at any time by informing you of such modifications when you attempt to sign in to your account and requiring you to agree to them as a condition of continued Services. Our right to amend the Agreement includes the right to modify, add to, or remove terms. Any modification or change does not affect and does not apply to Orders which have already been placed. Your continued access or use of our Services constitutes your acceptance of the amended terms.
